Hartley v. Brazeal

[1] This is a proceeding to establish a private road under the provisions of Section 8488, R.S.Mo. 1939, Mo.R.S.A. The action was originally filed in the County Court of Douglas County, Missouri, on the 23rd day of March, 1946, wherein a judgment established the road prayed for was rendered and said cause was appealed to the Circuit Court of Douglas County. The cause was then removed by change of venue to Howell County, where, on trial anew, on the 2nd day of February, 1948, the court dismissed plaintiff's petition and denied the relief prayed for therein.
