The plaintiff, Joe E. Fryar, brought suit against Westside Habilitation Center (Westside) claiming that Westside had breached certain obligations owed Fryar under a construction contract for the development of a project known as Westside Habilitation Center. Westside, in turn, filed third party demands against various parties involved, including the defendant-relator, Bert Davis III.
