Appeal from an order of the Supreme Court (Kahn, J.), entered April 15, 1987 in Albany County, which in a proceeding pursuant to CPLR article 78, remitted the matter to respondent Commissioner of Education for further proceedings.

Petitioner, the Director of Parks for the City of North Tonawanda in Niagara County, was elected to the North Tonawanda Board of Education in 1986. Respondent William H.
