The Industrial Finance Corporation brought this suit against R. L. Scott on what is known as a trade acceptance, alleged' to have been drawn by the Studebaker Corporation of America, in favor of the Industrial Finance Corporation, on defendant, Scott, and accepted by him. The defendant answered that the trade acceptance was given in part payment for an automobile purchased by him from the Studebaker Corporation; that in the sale of the said automobile and contract in reference thereto the Studebaker Corporation and the plaintiff were partners; that the Studebaker Corporation guaranteed said…
