Motion by defendant for summary judgment under rule 113 of tbe Rules of Civil Practice.
Tbe complaint herein alleges the making of a lease on May 2, 1945, between the defendant’s assignor and the plaintiff. A copy of the lease is annexed to the complaint. The instrument purports to lease to the plaintiff a portion of the basement of the premises mentioned therein, to be used and occupied for a hat check and coatroom concession, for a term commencing April 1,1945, and ending March 31, 1948.
