Johnson v. Wilkinson

Contract for the breach of an oral agreement to allow the plaintiff the use of a hall in Chelsea, in a building owned by the defendant. Trial in the Superior Court, before Grardner, J., who directed a verdict for the defendant, and reported the case for the determination of this court. The facts appear in the opinion.

There was evidence tending to show that the defendant, who was the owner of a hall, entered into an oral contract with the plaintiff, by which he agreed to permit the plaintiff to use the hall for dancing parties on the afternoons of four holidays, Thanksgiving, Christmas, Washington’s Birthday, and Fast day, at a stipulated price for each afternoon. The Superior Court directed a verdict for the defendant, upon the ground that this contract was within the statute of frauds, being a contract for the sale of an interest in land. Pub.
