In this diversity contract action, plaintiff The Nielsen Company (“Nielsen”) seeks to recover the damages allegedly arising out of its failed business relationship with defendant Success Systems, Inc. (“Succéss”). Nielsen had retained Success to help automate its collection of data from a statistically-representative sample of independent and small-chain' convenience stores.
