Certifying the law.

On the 7th day of December, 1909, appellee sold without license, a pint of whisky to one Simmons in Danville, Boyle county, Kentucky. He was arrested for making this illegal sale and tried in the police court, convicted, and his punishment fixed at $100 fine ancl forty days in the workhouse at hard labor. Appellee appealed from this judgment to the circuit court, and upon the trial there, the court held that the local option law is not in force in Danville, and that the defendant could be convicted only under section 1304, Ky.
