Plaintiff brought this action to recover upon an alleged contract of insurance insuring certain buildings owned by the plaintiff against loss by tornado, cyclone and windstorm. The 'sole question presented by the appellant on this appeal is whether a contract of insurance had been consummated so as to render the defendant liable as an insurer. It is admitted that the buildings owned by the plaintiff and claimed to be covered by the insurance contract were damaged by a windstorm, and the amount of damages sustained has been stipulated.
