The defendant was convicted upon his plea of guilty of the offence of selling intoxicating liquors without license in the village of Gloversville, in the county of Fulton, before a justice of the peace residing in that village; and was sentenced therefor to imprisonment in the Albany penitentiary for the term of sixty days.
*39On appeal to the Fulton sessions the sentence Avas modified to imprisonment for the same term in the county jail; and the conviction and sentence as modified were affirmed. From this judgment of the Fulton sessions an appeal was taken to this court.
