The appellant was indicted, tried, and convicted for the murder of Charlie McLeod, his first cousin, and sentenced to imprisonment for life in.the state penitentiary.
The evidence shows that on the morning of the killing the appellant and the deceased were at Sunday school in a church in the neighborhood; that the appellant was drunk at Sunday school, and dropped his pistol from his pocket.
