John Don Layton was convicted of unlawful manufacture of methamphetamine, possession of methamphetamine with intent to distribute, possession of drug paraphernalia, and criminal possession of a firearm. His convictions and sentences were affirmed by the Court of Appeals in State v. Layton, 31 Kan. App. 2d 350, 65 P.3d 551 (2003). This court granted Layton’s petition for review of the Court of Appeals’ decision on the single issue of his sentence for unlawful manufacture of methamphetamine.
