DAWKINS, District Judge.

Plaintiff sues for an accounting of the oil and gas produced from the SWj4 of SWYa of Section 12, Tp. 10, N. R. 2 E., and to be recognized as the owner of a one-fourth interest in all of the minerals in and under said tract. She is therefore the plaintiff in a petitory action which requires her to make out a title superior to all others. There is attached to the petition all of the deeds or titles *37affecting plaintiff’s rights, as well as those of the defendant.
