— The matter comes before the court on appeal of the Commonwealth of Pennsylvania by the Pennsylvania Public Utility Commis*380sion from the dismissal of complaints against Sarah Cerine, Joseph Benci and Naldo Guccini by Lloyd Gumble, justice of the peace in and for Paupack Township, Pike County, Pa. The complaints charged defendants with operating motor boats for compensation without a certificate of public convenience, in violation of the Pennsylvania Public Utility Law.
