This is the decision on the second phase of the action for declaratory judgment brought by the State of Delaware on the relationship of the Attorney General against The Pennsylvania Railroad (“The Pennsylvania”). As I have previously indicated, the controversy is over title and related rights to certain foreshore, which is a strip of soil between high and low water marks on the westerly side of the Delaware River.
