This is an action for damages for personal injuries. Plaintiff recovered a verdict and judgment in the sum of $5000 and defendant has appealed.

The evidence shows that on the 8th day of April, 1924, plaintiff was employed as a hammersmith by the defendant in its shops at North Little Rock, Arkansas, and in the discharge of his duties was engaged in finishing a coach equalizer weighing several hundred pounds.
