This case came up regularly for trial in this Court. Upon the day fixed, counsel for appellee, in open court, moved to dismiss the appeal, upon the grounds that the record *112contained no bill of exceptions or statement oí facts, and that all the evidence adduced below is not therein; and that it does not contain the detailed list of the pleadings as required by rule No. 5 of the rules of this Court.
