HALLEY, Justice. ■
This action was commenced in the District Court of Oklahoma County by Frances E. Smith against the Y & Y Cab Company to recover damages for personal' injuries and property damage resulting from an aütomobile collision bn July 22, 1953; at the intersection- of Broadway and Northwest Second Street in Oklahoma City. We shall refer to. the parties as they appeared in the trial court.
