On the 13th day of March 1876, the plaintiff sued out of the clerk’s office of • the circuit court, of the *310county of Greenbrier, a summons in chancery against Alexander F. Mathews administrator of P.' A. Prindle deceased, et al.; and afterwards, on the first Monday of April 1876, the plaintiff filed his bill of injunction with the exhibits therein referred to, in the same office.
