The plaintiff in error brought ejectment for a lot of land in the city of Natchez, and to the opinion of the court in ruling out his title papers, he excepted.

He claimed title to the lot in controversy, as the purchaser at *620a sale made by the marshal of the southern district of Mississippi, and introduced the judgment and a fieri facias thereon, which was levied on the lot, but the sale was suspended by supersedeas.
