MEMORANDUM & ORDER

GERSHON, District Judge.

Petitioner, Robinson Rodriguez, brings this petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Petitioner was convicted after a jury trial in New York State Supreme Court, Kings County (Greenberg, J.), of sodomy in the first degree pursuant to N.Y. Penal Law § 130.50[3], and was sentenced on October 5, 1998 to a term of ten to twenty years. Petitioner’s crime consisted of anal intercourse with his six-year-old autistic stepson.
