OPINION

HAIRE, Judge.

The issue in this appeal is whether Arizona’s penal provisions establishing the crime of unlawful imprisonment may be applied to the factual circumstances of this case involving the confinement by appellant of her four year old daughter overnight in a rental storage locker. We hold that appellant’s conviction must be reversed because the evidence will not support a conviction on the charge of unlawful imprisonment.
