MEMORANDUM OPINION
LAMBERTH, District Judge.
This matter comes before the Court on the defendants’ Motion [18] to Dismiss. Upon consideration of the defendants’ motion, the opposition thereto, the reply brief, the applicable law, and the entire record herein, the Court concludes that the defendants’ motion will be denied. Also pending before this Court with regard to the instant motion are Plaintiffs’ Motion [35] to Strike Defendants’ Supplement to their Reply and Plaintiffs’ Consent Motion [36] to File a Sur-reply.
