On two former occasions judgments in favor of the appellee were reversed, and the cause was remanded for a new trial. Illinois C. R. R. Co. v. Swisher, 53 Ill. App. 411; Illinois C. R. R. Co. v. Swisher, 61 Ill. App. 611. Appellee having obtained another judgment the appellant has brought the case to this court for the third time. Concerning the issues upon the original declaration as amended, the record discloses no substantial variation from the case as presented to the court at the several times to which reference has been made, and we are content to rest the ease upon the reasoning of the…
