CLOPTON, J.-
The uncontroverted facts are: that on March 30,1871, there stood on the books of the Montgomery Gas-Light Company, a corporation, thirty shares of its capital stock, in the name of “J. S. Winter, trustee for Mary E. Winter.” On that day, J. S. Winter, trustee, assigned the thirty shares to J. Gindrat Winter, which transfer was registered on the books of the company. On August 21, 1871, certificates for the five shares in controversy, being part of the-thirty shares, were issued by the company to J.
