KOCH, Judge.

This appeal arises out of a dispute over the construction of the residuary clause in the will of C.C. Robison, the brother of the appellant and the uncle of the appellees. The issue to be decided is whether the testator intended to give a portion of his residuary estate to any of his nieces and nephews if any of his brothers and sisters survived him. In granting the nieces’ and nephews’ motion for summary judgment, the Chancery Court for Maury County concluded that the testator intended that his nieces and nephews should take their deceased parents’ share of the residuary…
