The defendant appeals from a finding of guilty at a jury waived trial in the Superior Court on an indictment charging him with larceny. The appeal is pursuant to G. L. c. 278, §§ 33A-33G.

The following facts are pertinent. On September 25, 1973, complaints charging the defendant with larceny and conspiracy to commit larceny were issued by the District Court of Western Norfolk.
