In this action, tried by the court without a jury, the respondent, Frowd, recovered against the appellant, Marchbank, for the value of two cows that were killed, and for the loss in value of certain others that were injured, by an automobile driven by the appellant.

The principal facts giving rise to the action are not in substantial dispute. The respondent owns certain farm and pasture lands situated in the county of Clark.
