MEMORANDUM OF DISSENT
POINTER, District Judge.
From the circumstances presented to it, the Commission might well have decided to grant Colonial’s request for a waiver of the rules. There had been an abnormal delay between issuance of the new certificate and its receipt by Colonial. Within 60 days after that receipt, Colonial had completed the time-consuming process of computing its eligibility for “E” filings and had submitted its completed letter notices, eleven in all. The public interest would presumably be served by granting Colonial’s applications.1 The alternative to a waiver of the rules…
