OPINION

SAYLOR, Justice.

This is an appeal from the denial of a petition seeking relief under the Post Conviction Relief Act, 42 Pa.C.S. §§ 9541-9546, in a capital case. Concluding that the petition was untimely, we affirm.

I. Background

On July 1,1982, a jury convicted Appellant, Nicholas Yarris, of kidnapping, rape, robbery, and first degree murder in connection with the fatal stabbing of Linda Craig, a salesperson at a shopping mall in the state of Delaware, in December of the previous year.
