By an order entered on January 22, 1953, the Circuit Court of Monongalia County, over the objections and exceptions of A|. I. Clawges, Trading and Doing Business as Clawges Transfer, and Ewing Montgomery, the defendants in an action of trespass on the case, instituted in the Circuit Court of Monongalia County by Orlie Fay, Administrator of the Estate of Thomas Orlie Fay, deceased, against A.
