BREITENSTEIN, Circuit Judge.

A jury found appellant Leino guilty of a violation of the Dyer Act 1 and he appeals.

Leino was arrested in New Mexico on November 15,1962, and released on bond. The indictment was returned on April 26, 1963. Arraignment was continued three times because Leino did not appear. On October 4, 1963, Leino was present for arraignment. After the court explained his right to counsel, Lei-no asked for a continuance so that he could employ counsel.
