This was a suit in an action on the case by appellee against appellant to recover for damages arising from an injury receiver by the latter by reason of the train, on which he was fireman, colliding with another train running in the opposite direction on appellant’s road, causing appellee, to save himself, to jump from his engine and injure himself.
