Charles H. Schambers, the defendant, was indicted for unlawful possession and transportation of intoxicating liquor and driving an automobile while intoxicated. A jury found him guilty of unlawful transportation and possession and acquitted him of the charge of driving while intoxicated. A deputy sheriff having observed the defendant driving the car in an erratic manner and colliding with another car immediately made an arrest and upon search of the car found a quart bottle two-thirds filled with moonshine whiskey.
