Mr. Justice Allen,
sitting for Mr. Chief Justice Teller, delivered the opinion of the court.
The plaintiff in error was convicted of the crime of obtaining money by means of false pretenses and was sentenced to the state penitentiary. The cause is before us on his application for a supersedeas.
According to the information upon which the prosecution was had, the alleged false pretenses involved the issuance by the accused of a check for $181.85, on February 14, 1924, to the prosecuting witness, by means of which check the defendant obtained from such witness the sum of $75.
