While the above entitled action was pending in the superior court of Snohomish county, and after it had been set for trial, the plaintiff applied to this court for a writ of prohibition directed to the judge of the superior court to prohibit the trial with the jury then summoned to try the cause. An. alternative writ was granted by this court, and before the hearing thereof the case was set for trial by the superior.court and another jury called.
