— This is a suit to recover damages for personal injuries. The defendant prevailed in the lower court, and the plaintiff has appealed.
The essential facts are as follows: The appellant was employed by one Moreland1 to drive one of several teams which the latter had hired to the respondent. At the time of the happening of the accident, the respondent was engaged in plowing the south side of Jackson street, in the city of Seattle, preparatory to grading and paving it.
