Respondent has submitted an order to show cause seeking to prevent the marshall from executing a warrant of eviction requested by the landlord in this action.

On October 21, 1997 counsel for the petitioner submitted an affirmation which requested that the clerk of the court issue the warrant of eviction since the respondent had failed to comply with the terms of the stipulation entered into between the parties and “so ordered” by the court on August 6, 1997.
