This is a matter in probate, the controversy concerning the application of the executor for authority to mortgage the real estate to secure funds with which to pay claims against the estate, and the resistance of certain heirs thereto.

The executor’s application asserts that the deceased left no personal property, but died owning 1,440 acres of land in Audubon county, Iowa; claims and expenses of administration amount to nearly $60,000; there are no funds in the estate with which to pay the same; sale of two half sections was authorized in 1935, but the market was not favorable, said land…
