This is an action to establish title to real estate as provided by Act No. 38 of 190S, where two or more persons claim by recorded title, and neither of them are in actual possession of the premises.
The land in dispute, consisting of several sectional subdivisions, containing a total area of 240 acres, was assessed to Thomas P. Kenny, the original entryman for the taxes of the year 1881. The taxes were not paid, and on May 20, 1882, the property was exposed at tax sale and adjudicated to Simon Witowski, and a few days later a formal tax deed to the purchaser was duly executed and recorded.…
