This is an appeal from a judgment rendered against plaintiff in error, T. H. Ray, in the district court of Lincoln county, in an action wherein the defendant in error, Richards & Conover Hardware Company, sought to recover on certain notes and on an account. Defendant brings the cause here for review assigning several grounds of 'error, and presents in his brief three of the errors assigned, the first being:
