This action was brought before a justice to recover as damages the value of the plaintiff’s cow, alleged *131to have been killed by. negligence on the track of the appellant’s railroad where it was not fenced. The justice dismissed the complaint, and on appeal to the circuit court the case was tried before a jury, and the court submitted to the jury only the question of the value of the cow, and the verdict was $31.35 damages for the plaintiff. This is an appeal from the judgment on that verdict.
