Upon an indictment for the murder of an illegitimate infant, the respondent was tried and acquitted. In the present case, he was on trial for adultery alleged to have been committed with the mother of the infant. In the former case, he was a witness in his own behalf, and was cross-examined by the government with a view of eliciting admissions tending to show that the paternity of the child was his.
