Curry was remanded in habeas corpus proceedings and was allowed and took writ of error.

The charge on which he was held is that “said Lawrence Curry being then and there an alien or non-resident of the State of Florida, did then and there engage in taking fish with a hook and line only from the salt waters of the State of Florida in a boat, which said boat was then and there engaged in the fishing industry in the State of Florida in the County of Dade and State of Florida, as aforesaid, and which boat was then and there operated in part by him, the said Lawrence Curry, a nonresident as…
