On the night of September 9,1939, Mary Frances Carter, a colored woman twenty-five years of age; was walking along the Spottswood Trail between Gordonsville and Barboursville, accompanied by a colored man named Elijah Quarles. They were walking in a westerly direction on the left side of the road when a car owned and driven by W. Clyde Locker struck the young woman, inflicting upon her injuries of a serious and permanent nature. She filed suit against Locker alleging' his negligent operation of the car, and the jury awarded her a verdict of $500, upon which judgment was rendered by the trial…
