The defendant was found guilty on May 29, 1925, in the Circuit Court of Cape Girardeau County, of robbery in the first degree and appealed from a sentence of imprisonment in the penitentiary for a term of ten years.

An indictment was returned by the grand jury of Scott County on December 17, 1924, charging that the defendant and Clarence Parsons, on or about June 27, 1924, at the County of Scott, unlawfully and feloniously assaulted F.T. Cutliph, cashier and in charge of the Vanduser District Bank, a banking corporation, and then and there, by violence to the said F.T. Cutliph and by putting…
