Proceeding pursuant to Executive Law § 298 (transferred to the Appellate Division of the Supreme Court in the Fourth Judicial Department by order of the Supreme Court, Erie *1429County [Rose H. Sconiers, J.], entered September 26, 2007), to annul a determination of the Commissioner of respondent-petitioner New York State Division of Human Rights. The determination found that petitioner-respondent had discriminated against respondent and had constructively discharged her from employment.
