This is a bill in equity, filed in the Superior Court, against the assignee of the Smith and Gardiner Supply Company, to restrain the foreclosure of a mortgage given to the plaintiff by the Automatic Time Stamp and Register Company, and assigned by him as collateral security to the Smith and Gardiner Supply Company. The plaintiff also sought by the bill to redeem the mortgage so assigned, and on payment of the amount due to have the mortgage reassigned to him.
