on re-hearing —The argument at the'rehearing properly suggests two questions for our determination. These are—First, whether the writing purporting to be a dissolution agreement was properly excluded from tbe consideration of the jury, except for tbe purpose stated in tbe bill of exceptions; and second, wbetber, -when a bill of exceptions states that tbe court “instructed tbe jury upon all tbe issues involved in tbe case, and upon matters properly for their consideration,” but no part of such charge or instructions are incorporated therein, and certain instructions asked and refused…
