Relator, Victor Hugo Escareno, filed a motion for leave to file a writ of mandamus pursuant to the original jurisdiction of this Court. He asserted that he filed an application for a writ of habeas corpus in the 370th District Court of Hidalgo County, Texas, on October 29, 2007, and that thirty-five days passed without the trial court forwarding the application to this Court.
